These Terms & Conditions apply to photography services provided by Lewis Housden Portrait Photography (“I”, “me”, “my”, “we” or “the Photographer”).

By making a booking, you agree to these Terms & Conditions.

Nothing in these Terms & Conditions affects any statutory rights you have as a consumer.

1. The Photography Service

I provide professional photography services including portrait, family, professional headshot, studio, outdoor and performance photography.

The specific service, package, price, date, time, location and deliverables will be agreed with you before your booking is confirmed.

I will provide the service with reasonable care and skill, in accordance with applicable consumer law.

2. Booking and Contract

A booking becomes confirmed when:

  1. The requested service and date have been agreed;
  2. I have confirmed the booking; and
  3. Any required deposit has been paid.

The booking confirmation and any written quotation or invoice form part of the agreement between us.

If there is a conflict between these Terms & Conditions and a specific written agreement made with you, the specific written agreement will take precedence to the extent of the conflict.

3. Prices

All prices will be confirmed before the booking is made.

Unless otherwise stated, the price quoted includes the photography services and deliverables specifically described for that package.

Any additional services, products or expenses requested after booking may incur additional charges, which will be agreed with you before they are provided.

4. Deposit

A deposit of 15% of the total service fee is normally required to secure a booking.

The deposit is applied towards the total price of the service.

The deposit is not intended to be a penalty for cancellation. Where you have a statutory right to cancel, your statutory rights will apply.

Where a cancellation occurs outside any statutory cancellation right, the treatment of the deposit will depend on the circumstances, including the amount of work already carried out, costs incurred and the terms agreed at the time of booking.

5. Payment

The remaining balance will normally be invoiced on the day after the photography session.

Unless otherwise agreed in writing, the balance is payable within 14 days of the invoice date.

I reserve the right to withhold delivery of final images where payment remains outstanding, subject to applicable law.

If an invoice remains unpaid after the due date, I may contact you to request payment and may take further reasonable steps to recover the outstanding balance.

6. Single Parent Discount

Single-parent families are eligible for a 50% discount on all Family Packages, excluding the Family Plus Package. The discount is available where there is one responsible paying adult aged 21 or over attending the photoshoot. Children and dependants aged 20 or under may attend as part of the family group and do not affect eligibility for the discount. The discount cannot be combined with any other offer or promotion. 7. Travel

Travel is included for sessions taking place within 15 miles of Petersfield.

Where a session location is more than 15 miles from Petersfield, additional travel may be charged at 45p per mile for the applicable journey.

Any additional travel charge will be communicated to you before the booking is confirmed.

8. Cancellation by the Client

If you need to cancel your booking, please notify me as soon as reasonably possible by email.

Where your booking is a distance or off-premises consumer contract, you may have a statutory right to cancel within 14 days of entering into the contract, subject to applicable exceptions and the circumstances in which the service is due to begin.

If you request that the photography service begins before the end of any applicable cancellation period, the legal consequences of cancellation may differ, and I will provide the information required by law.

Outside any statutory cancellation rights, cancellations will be dealt with fairly and in accordance with the circumstances of the booking.

Where appropriate, I may offer an alternative date rather than treating the booking as cancelled.

9. Rescheduling

I will make reasonable efforts to accommodate requests to move a session to another date.

Rescheduling is subject to availability.

Where a session needs to be moved because of weather, illness, venue problems or another reasonable circumstance, I will work with you to arrange an alternative date where possible.

Repeated or unreasonable requests to reschedule may result in the booking being treated as cancelled.

10. Weather

For outdoor photography, weather conditions may affect the suitability of the planned session.

If I consider the weather to make the session unsafe, impractical or likely to materially affect the quality of the service, I may recommend postponing the session.

Where possible, an alternative date will be arranged.

11. Cancellation or Rescheduling by the Photographer

I reserve the right to cancel or reschedule a booking where circumstances outside my reasonable control prevent me from providing the service.

This may include serious illness, injury, equipment failure, extreme weather, venue closure, emergencies or other circumstances that make providing the service impractical or unsafe.

Where I cancel a booking, I will make reasonable efforts to offer an alternative date.

Where I am unable to provide the agreed service and the contract is terminated as a result, any refund due will be handled in accordance with applicable law and the circumstances of the cancellation.

12. Photographer Illness or Emergency

If I become unable to attend a session due to illness, injury or emergency, I will notify you as soon as reasonably practicable.

Where possible, I may arrange a suitable replacement photographer with your agreement or offer an alternative date.

If neither option is reasonably possible, I will refund payments that are legally required to be refunded.

13. Client Responsibilities

You are responsible for:

  • Providing accurate booking information.
  • Arriving at the agreed location on time.
  • Ensuring that you and any other participants are ready for the session.
  • Following reasonable safety instructions.
  • Informing me of any circumstances that may materially affect the session.
  • Obtaining any permissions required for the use of a chosen location.
  • Supervising children participating in a session.
  • Ensuring that any pets involved in a session are appropriately controlled and supervised.

I cannot guarantee particular photographs where the outcome is affected by circumstances outside my reasonable control.

14. Late Arrival

If you arrive late, the available photography time may be reduced where another booking or commitment follows your session.

I will make reasonable efforts to accommodate lateness where possible.

A significantly late arrival may affect the number of photographs that can reasonably be created during the session.

15. Image Selection and Editing

I retain creative discretion over the images selected for delivery and the editing style applied to them.

The final gallery will contain images that I consider to meet my professional standard.

I do not provide every photograph taken during a session.

RAW files and unedited photographs are not included unless specifically agreed in writing.

Requests for extensive additional editing or substantial alterations outside my normal editing style may incur an additional charge.

16. Delivery of Photographs

Final photographs will normally be delivered through an online gallery or another digital delivery method agreed with you.

I will make reasonable efforts to provide the gallery within the timeframe communicated to you.

Unless otherwise agreed, galleries will remain available for approximately one month following delivery.

You are responsible for downloading and securely storing your photographs during the period that the gallery is available.

I recommend keeping at least one additional backup of your photographs.

17. Copyright

Copyright in all photographs remains with Lewis Housden Portrait Photography unless otherwise agreed in writing.

You do not purchase copyright when purchasing photography services or digital images.

I retain the right to reproduce, edit, publish and otherwise use my photographs as permitted by copyright law, subject to any agreements regarding privacy, confidentiality and promotional use.

18. Client Usage Licence

Once full payment has been received, I grant the client a non-exclusive, personal-use licence to use the final delivered photographs.

This licence permits you to:

  • Download and store the photographs.
  • Print the photographs for personal use.
  • Share the photographs with friends and family.
  • Post the photographs on personal social media accounts.
  • Use the photographs for other reasonable personal purposes.

You must not:

  • Sell the photographs.
  • Licence or sublicense the photographs to another person or organisation.
  • Use the photographs for commercial advertising or promotional purposes without written permission.
  • Claim authorship of the photographs.
  • Alter the photographs in a way that materially misrepresents my work.

Commercial usage can be licensed separately where appropriate.

19. Social Media

You may share your delivered photographs on social media for personal use.

Where practical, I would appreciate being credited when photographs are shared, although this is not a condition of the personal-use licence unless otherwise agreed.

I may request that you do not apply filters or edits that materially alter my work when representing it as my photography.

20. Portfolio and Promotional Use

I may use photographs for portfolio, website, social media, advertising, competitions, exhibitions and other promotional purposes only where I have the necessary permission or other lawful basis.

Where promotional consent has been specifically requested and declined, I will not use those photographs for that purpose.

21. Privacy and Confidentiality

Personal information will be handled in accordance with my Privacy Policy.

I will take reasonable steps to keep client information confidential except where disclosure is necessary to provide the service, comply with legal obligations, protect my business or is otherwise permitted by law.

22. Location and Venue

The client is responsible for ensuring that the chosen location or venue permits photography where permission is required.

Any venue fees, permits, entrance fees or other location charges are the client’s responsibility unless explicitly included in the agreed price.

23. Personal Safety

I will take reasonable steps to conduct photography sessions safely.

Clients and participants must follow reasonable safety instructions.

I reserve the right to stop or refuse to continue a session where I reasonably believe that continuing would create an unacceptable risk of injury or damage.

24. Pets

Where pets participate in a session, the owner remains responsible for their behaviour, supervision and welfare.

I cannot guarantee that a pet will behave in a particular way or appear in a particular photograph.

Any damage caused by a client’s pet may be the client’s responsibility where legally appropriate.

25. Force Majeure

Neither party will be responsible for failure to perform an obligation where the failure results from circumstances reasonably beyond their control.

Such circumstances may include severe weather, natural disasters, serious illness, accidents, government restrictions, venue closure, significant technical failures or other emergencies.

The affected party will notify the other party as soon as reasonably practicable.

26. Limitation of Liability

Nothing in these Terms & Conditions excludes or limits liability where doing so would be unlawful.

In particular, nothing excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot legally be excluded or limited.

Subject to the above, I will not be liable for losses that were not reasonably foreseeable at the time the contract was entered into or losses that were not caused by my breach of contract or negligence.

Nothing in these Terms & Conditions affects your statutory consumer rights.

27. Complaints

If you are unhappy with any part of the service, please contact me as soon as reasonably possible so that I have an opportunity to investigate and resolve the issue.

I will consider complaints fairly and aim to resolve them promptly.

28. Governing Law

These Terms & Conditions are governed by the law of England and Wales.

Where you are a consumer, you will also retain any mandatory rights and protections provided by the law applicable to you.

29. Changes to These Terms

I may update these Terms & Conditions from time to time.

The Terms & Conditions applicable to your booking will normally be the version provided or made available to you when the booking is made.

Changes made after your booking will not retrospectively alter the terms of an existing contract unless you agree to the change or the law permits it.
