TERMS & CONDITIONS

These Terms & Conditions set out the agreement between Lewis Housden Portrait Photography (“we”, “us”, “our”) and you (“the client”) for all photography services. By booking a session, you agree to these terms in full.

1. DEFINITIONS

  • Services: The photography services we provide as described in Schedule A.
  • Products: Any prints, albums, or other physical goods purchased after your session.
  • Client/You: The person booking and paying for the services.
  • We / Us: Lewis Housden Portrait Photography.

2. BOOKINGS & DEPOSITS

  • A non-refundable deposit of £30 is required to secure your booking.
  • This deposit will be deducted from your final balance, which will be clearly stated on the invoice sent the day after your photoshoot.
  • Complimentary photoshoots (e.g., via giveaways, collaborations, or promotions) do not require a deposit. These sessions are free of charge unless you choose to purchase additional images or upgrades.
  • Deposits are refunded only at our discretion in cases of severe circumstances.

3. PAYMENT TERMS

  • Invoices are sent the day after your photoshoot.
  • Full payment is due within 14 days of the invoice date.
  • Travel is included for locations within a 15-mile radius of Petersfield (30 miles round trip). Any additional travel beyond this is charged at £0.45 per mile (round trip), calculated using the fastest direct driving route.

4. SCHEDULE A

  • Details such as session type, location, timings, and deliverables will be confirmed in Schedule A, provided to you before your session.
  • Schedule A forms part of this agreement.

5. CANCELLATIONS & RESCHEDULING

  • We will always try to accommodate rescheduling requests.
  • In the event of cancellation, your deposit is non-refundable (except in exceptional cases at our discretion).
  • If we are unable to perform the services due to illness, injury, or unforeseen events, we will offer to reschedule or refund any payments made (including deposits).

6. CLIENT RESPONSIBILITIES

  • Please arrive on time and ready for your session.
  • Let us know of any special requirements or restrictions in advance.
  • You are responsible for ensuring all people being photographed are aware of the session and have given consent.

7. IMAGE DELIVERY

  • Digital images will be delivered via an online gallery after full payment is received.
  • Online galleries will remain live for one (1) month from the date of initial image delivery.
  • Clients are responsible for downloading their images and placing any print orders within this period.
  • final reminder of gallery expiration will be sent two (2) days before expiry, provided the client has registered for access to the gallery and/or downloaded images from it.
  • After the one-month period, galleries may be removed without further notice.
  • Prints can be purchased separately through the same gallery.
  • Redelivery or reactivation of an expired gallery will incur a fee, as specified in Schedule A of the contract signed upon initiation of services.
  • Delivery times may vary; we will give you an estimated timescale before your session.

8. COPYRIGHT & USAGE

  • We retain copyright to all images unless explicitly transferred in writing.
  • A full usage licence for personal use is granted once full payment is made.
  • You may opt out of your images being used for our portfolio, website, or social media.

9. EDITING & ALTERATIONS

  • We retain full control over the style and editing of images.
  • Images must not be altered, filtered, or edited by third parties without our consent.

10. LIMITATIONS OF LIABILITY

  • While we take great care to capture important moments, we are not liable for missed shots due to factors beyond our control (e.g., weather, lateness, restrictions at venues).
  • Our total liability for any claim relating to the services will not exceed the total amount paid by you.

11. GIFT VOUCHERS

  • Vouchers are valid for 12 months from the date of purchase.
  • They are non-refundable and cannot be exchanged for cash.
  • Sessions must be booked before the expiry date.

12. DATA PROTECTION

  • We handle your personal information in accordance with our Privacy Policy.

13. CHANGES TO THESE TERMS

  • We may update these Terms from time to time.
  • The version in effect at the time of your booking will apply to your session.

14. DISPUTES & GOVERNING LAW

  • Any disputes will be handled directly between you and us.
  • Our decision on creative and technical matters is final.
  • This agreement is governed by UK law.
